Terms of Service

The service

Cuppafolio is a web-based tool for designing photo albums and exporting them as print-ready PDF files. We provide the design software and the export; we are not a print lab, a fulfilment service, a client gallery, or a studio CRM. You are responsible for choosing a printer and for the final printed result.

Your account

You must provide accurate information, keep your credentials secure, and be responsible for activity under your account. You must be able to form a binding contract and use Cuppafolio for professional or business purposes. You are responsible for anyone you allow to use your account.

Free trial & billing

• Every account starts with a 3-day free trial. A valid payment method is required to begin the trial.
• You are not charged during the 3-day trial. Unless you cancel before it ends, your selected plan begins automatically on day 4 and the payment method on file is charged. You can cancel at any time during the trial from your billing settings to avoid being charged.
• If you cancel or a payment later fails, your account moves to a read-only state and your work is not immediately deleted (see our Privacy Policy for retention timelines).
• Paid plans are billed in advance, monthly or annually, through our payment processor (Stripe). Prices are shown in GBP and exclude any taxes that may apply.
• You can upgrade, downgrade or cancel at any time from your billing settings. Upgrades take effect immediately; downgrades and cancellations take effect at the end of the current billing period. Except where required by law, payments already made are non-refundable.

Your content & ownership

You retain all rights to the photographs and album designs you upload and create (“your content”). We claim no ownership of it. You grant us only the limited licence needed to host, process and render your content so we can provide the service to you — for example, generating thumbnails and producing your export.

The PDF files you export are yours. There is no per-album fee, no watermark, and no licence to renew to keep using files you've already exported. You are free to print them with any provider you choose.

Acceptable use

You agree not to:

• upload content you do not have the rights to use, or that is unlawful, infringing or abusive;
• attempt to breach security, access other studios' data, or disrupt the service;
• reverse-engineer, resell or rent the service except as permitted by law;
• use the service in a way that places an unreasonable load on our infrastructure or circumvents plan limits.

We may suspend or terminate accounts that materially or repeatedly breach these terms, generally after notice where practical.

Availability & changes

We work hard to keep Cuppafolio available and reliable, but the service is provided on an “as is” and “as available” basis without warranties of any kind. We may update, improve or modify features over time. If we plan to discontinue the service, we will give reasonable notice and a window to export your content.

Limitation of liability

To the maximum extent permitted by law, Cuppafolio is not liable for indirect, incidental or consequential losses, lost profits, or loss of data, and our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim. You are responsible for keeping your own copies of exported files and for verifying any file with your chosen printer before going to press. Nothing in these terms excludes liability that cannot be excluded by law.

Termination

You may stop using the service and delete your account at any time from your settings. On termination, your right to use the service ends and your content is handled according to the retention timelines in our Privacy Policy. Sections that by their nature should survive termination (such as ownership, liability and these general terms) will continue to apply.

General

These terms make up the entire agreement between you and Cuppafolio regarding the service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. We may update these terms; if we make material changes we will update the “last updated” date above and, where appropriate, notify you. Questions?
